Terms of sale
These General Terms and Conditions of Sale (hereinafter "GTC") are entered into on one hand by Aphelios SASU, a company incorporated under French law, registered with the Paris Trade and Companies Registry under number 105 719 587, with its registered office at 47 Rue Vivienne, 75002 Paris, trading under the name Cenedia, and on the other hand by any person visiting and/or making a purchase on the website cenedia.com, hereinafter referred to as "the User". Any purchase or visit on cenedia.com automatically constitutes acceptance of these terms in their entirety.
PRELIMINARY ARTICLE – DEFINITIONS
Customer: any User of the Site who purchases a Product through the Site.
Order: the process by which the Customer selects and pays for Products on the Site.
Product: refers to any product that can be viewed or purchased on the Site.
User: anyone who accesses the Site.
ARTICLE 1 – PURPOSE AND SCOPE
These GTC define the conditions of use of the Site.
Every User agrees, without reservation, to comply with these GTC.
All new features added after the publication of these GTC will equally be subject to them.
ARTICLE 2 – APPLICABLE VERSION
The prevailing version of the GTC is the latest version available on the Site.
Aphelios is free to update or replace any part of these GTC at any time.
ARTICLE 3 – CONDITIONS OF USE OF THE SITE
The Site is hosted on Shopify Inc.
By accepting these GTC, the User confirms they have reached the age of majority.
The User agrees not to use the Products for illegal or unauthorized purposes.
The operation of the Site may be interrupted at any time by Aphelios without prior notice.
ARTICLE 4 – GENERAL CONDITIONS
Aphelios reserves the right to refuse access to its services to anyone, at any time.
Aphelios reserves the right to limit the quantities of any Product offered.
Descriptions and prices may be modified without notice.
ARTICLE 5 – PRICES
The prices applied are those displayed on the Site at the time of the Order.
Prices are in euros, inclusive of applicable taxes (VAT not applicable, pursuant to Article 293 B of the French General Tax Code).
ARTICLE 6 – PRODUCT PRESENTATION
Product photographs are provided to give the clearest possible representation.
Aphelios cannot guarantee that Products will be exactly identical to the photos (due to screen color rendering).
Aphelios reserves the right to correct any errors or cancel orders if any information is inaccurate.
ARTICLE 7 – OPTIONAL TOOLS AND THIRD-PARTY LINKS
Aphelios may provide access to third-party tools without exercising any control over them.
The use of such tools or third-party links is entirely at the User's own risk.
ARTICLE 8 – COMMENTS AND SUGGESTIONS
Aphelios reserves the right to use any content submitted by the User without compensation.
The User is responsible for the content and accuracy of their comments.
ARTICLE 9 – PERSONAL INFORMATION
The submission of personal information is governed by the Privacy Policy available on the Site.
ARTICLE 10 – BILLING ACCURACY
The Customer agrees to provide accurate and up-to-date account information.
Aphelios reserves the right to refuse Orders that appear to originate from resellers.
ARTICLE 11 – PROHIBITED USES
The User agrees not to use the Site for illegal purposes or to collect third-party data.
ARTICLE 12 – ORDER
An Order is finalized once payment has been received. A confirmation is sent by email.
An Order that is in the process of being shipped cannot be cancelled.
Aphelios undertakes to ship Products within 3 to 5 business days, subject to stock availability.
ARTICLE 13 – DELIVERY
Delivery takes place within an estimated timeframe of 7 to 21 business days after shipment.
Aphelios is not responsible for delivery delays caused by third-party carriers.
Tracking information indicating a successful delivery serves as proof of receipt of the Product.
ARTICLE 14 – RIGHT OF WITHDRAWAL
The Customer has 14 calendar days to exercise their right of withdrawal.
The product must be returned in its original packaging and in perfect condition.
Return shipping costs are the responsibility of the Customer.
ARTICLE 15 – LIMITATION OF LIABILITY
Aphelios' liability cannot be invoked in cases of force majeure or fault on the part of the Customer.
Use of the Site is entirely at the User's own risk.
ARTICLE 16 – INDEMNIFICATION
The User agrees to indemnify Aphelios against any claim arising from a breach of these GTC.
ARTICLE 17 – SEVERABILITY
If any clause is deemed invalid, it shall be severed without affecting the validity of the remaining clauses.
ARTICLE 18 – GOVERNING LAW AND CONTACT
These GTC are governed by French law.
